1. Acceptance of the Terms

By downloading, installing, accessing or using the LifeSugar mobile application (hereinafter, the “Service” or the “App”), you agree to be legally bound by these Terms and Conditions (hereinafter, the “Terms”). If you do not agree with any part of these Terms, you must not download, install or use the Service. These Terms constitute a legally binding agreement between you (the “User”) and LifeSugar Care (“LifeSugar”, “We” or “Our”).

2. Description of the Service

LifeSugar is a mobile application that supports meal logging and the approximate estimation of macronutrients. The Service includes:

• Approximate estimation of carbohydrates from photographs of food using artificial intelligence.
• A digital meal diary with logging of macronutrients (carbohydrates, protein, fat and calories).
• A barcode scanner to look up the nutritional information of packaged products.
• A summary and export of approximate nutritional data for personal use.
• The option to grant your healthcare professional access to a dashboard with your charts, portions and activity. You authorise the access, it is individual to each professional and you can revoke it at any time.

3. Nature of artificial intelligence and limitations

LifeSugar uses advanced artificial intelligence models to identify foods in images and estimate their nutritional content. You expressly acknowledge and accept that:

• AI technology is probabilistic by nature: the results are estimates, not exact measurements. The models can make errors in identification, in weight estimation or in nutritional calculation.
• The conditions of the photograph (lighting, angle, distance, overlapping foods) and non-visible ingredients (sauces, oils, hidden condiments) significantly affect the accuracy of the estimates.
• The results have not been clinically validated and must not replace professional medical judgement, manual carbohydrate counting or the nutrition labelling of products.
• LifeSugar is not a medical device under Regulation (EU) 2017/745 on medical devices, nor does it carry CE marking as such.

4. User responsibilities

As a LifeSugar user, you undertake to:

• Always verify the estimates generated by the AI before making any decision related to your medical treatment or the administration of insulin.
• Use your glucose meter, continuous glucose monitor (CGM) and the judgement of your healthcare professional to make therapeutic decisions.
• Not use the application as your only source of nutritional information in critical situations where a data error could harm your health.
• Keep your access credentials confidential and notify us immediately of any unauthorised use of your account.
• Provide truthful information when logging data manually in the meal diary.
• Comply with the applicable legislation when using the Service.

5. Acceptable use

You undertake not to use the Service for:

• Purposes other than those intended (personal meal logging and approximate estimation of macronutrients).
• Attempting to reverse engineer, decompile, disassemble or extract the source code of the application or its AI models.
• Sending images that are not of food or that contain inappropriate or illegal content or content that infringes the rights of third parties.
• Interfering with the normal operation of the Service or attempting to access the systems, accounts or data of other users.
• Reselling, sublicensing or commercialising access to the Service or the data generated by it without prior written authorisation.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFESUGAR, ITS DEVELOPERS, DIRECTORS, EMPLOYEES AND COLLABORATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGE ARISING FROM THE USE OF, OR INABILITY TO USE, THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, DAMAGE ARISING FROM INCORRECT ESTIMATES, EPISODES OF HYPOGLYCAEMIA OR HYPERGLYCAEMIA, KETOACIDOSIS, HOSPITALISATION OR OTHER HEALTH CONSEQUENCES. YOU USE THE SERVICE AT YOUR OWN RISK AND RESPONSIBILITY.

7. Disclaimer of warranties

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied. LifeSugar does not warrant that:

• The estimates of carbohydrates or other macronutrients are accurate, complete or reliable.
• The Service will operate uninterrupted, securely or free of errors at all times.
• The results obtained through use of the Service are suitable for medical or therapeutic purposes.

8. Intellectual property

The Service, including its design, source code, artificial intelligence models, nutritional database, logos, trademarks, texts, graphics and other original content, is and will remain the exclusive property of LifeSugar and its licensors. It is protected by the intellectual property, copyright and trademark laws applicable in Spain and internationally. Use of the Service does not grant you any licence or right over that intellectual property beyond personal use of the Service in accordance with these Terms.

9. Subscriptions, prices and usage limits

LifeSugar is offered through a paid subscription, preceded by a free 14-day trial period. All prices include applicable taxes, and the prices in force at any time are shown in the app and on the website.

• Monthly plan: €7.99 a month.
• Yearly plan: €69.99 a year. We may offer promotional launch prices; if there are any, their conditions and validity are shown in the app before you subscribe.
• Discounts: we may offer reduced prices to healthcare professionals, students and non-profit organisations, subject to proof of eligibility. The conditions are published in the app.
• Promotional codes: we may grant access to the paid features by means of codes. That access is not subscribed to through Google Play: we grant it directly, it lasts as long as the code indicates and expires automatically at the end of that period, with no renewal or charge of any kind. When it expires, if you want to keep using the paid features you will need to take out a subscription.
• Renewal and cancellation: subscriptions taken out through Google Play are billed in advance and renew automatically at the end of each cycle. You can cancel at any time from your Google Play account, and cancelling during the trial period avoids any charge. Any change in price will be communicated to you with the notice required by regulations and by Google Play before it applies to a subscription already in force.
• Fair use limit: AI meal analysis is subject to a daily fair use limit, sized so as not to affect normal personal use and intended to prevent automated or abusive use. If you reach it, AI analysis is temporarily unavailable until the next day; the rest of the app keeps working, and you can log meals by hand. The limit in force is published in the app.

10. Right of withdrawal

As a consumer, you have 14 calendar days to withdraw from the contract without having to give a reason and without penalty, counted from the date it was concluded (arts. 102 et seq. of Royal Legislative Decree 1/2007 — Real Decreto Legislativo 1/2007). To exercise it, it is enough to write to us at info@lifesugarcare.com saying that you are withdrawing: no form or reason is needed. This period coincides with the free trial period, so if you cancel before the first charge you pay nothing. If you expressly ask to start using the paid service before those 14 days end, you acknowledge that you will lose the right of withdrawal once the service has been fully performed (art. 103.m). We will ask you for this expressly and separately; if you do not accept, you keep the right. This right refers to paid subscriptions. Access granted through a promotional code is free and is not a sales contract, so it does not give rise to a right of withdrawal: it simply expires on the date indicated, with no charge.

11. Modification and termination

LifeSugar reserves the right to modify these Terms at any time. We will notify you of material changes through the app or by email at least 30 days in advance. Continued use of the Service after the notification constitutes acceptance of the modified Terms. We may suspend or terminate your access to the Service if you breach these Terms, without prejudice to our right to exercise any other legal remedy available.

12. Governing law and jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws in force in Spain. For any dispute arising from these Terms, both parties submit to the jurisdiction of the competent courts and tribunals under the Spanish legislation in force. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
